Introduction

Regulations

A.Purpose

To establish a registration system for Soil Pollution Assessment Investigation Personnel and improve the quality of site assessment, "Regulations on the Management of the Soil Pollution Assessment Investigation Personnel (RMSPAIP)" are formulated and promulgated.

B.Abstract

People who have obtained the training certificate of Soil Pollution Assessment Investigation Personnel and meet one of the following qualifications may apply to Ministry of Environment(MOENV) for registration:

1.Professional engineers with license of environmental engineering, civil engineering, applied geology, geotechnical engineering, soil and water conservation or agronomy.

2.Two years of work experience with supporting documents related to soil or groundwater contamination investigation, remediation or site assessment.


Soil Pollution Assessment Investigation Personnel who have completed the registration or re-registration can only carry out the assessment and investigation under Articles 8 and 9 of Soil and Groundwater Pollution Remediation Act(SGPRA). Registration or re-registration is valid for 4 years. Before applying for re-registration, Soil Pollution Assessment Investigation Personnel should attend soil or groundwater-related courses approved by MOENV for at least 32 hours.

Soil Pollution Assessment Investigation Personnel shall report the execution content to MOENV by network before 2 days of the date of site investigation.

The following circumstances shall not occur when Soil Pollution Assessment Investigation Personnel perform work:

1.Failure to correct, or concealment of untruth(s) or error(s) in the content of the soil pollution assessment investigation and test data.

2.Truths that should be explained in the soil pollution assessment investigation and test data and are not so done.

3.Failure to point out that assessment and investigation among the signed matters are inconsistent with laws and regulations or practices.

4.Did not personally go to the site for investigation and interviews.

5.Failure to report the implementation content in accordance with the regulations.

6.Did not personally go to the site to supervise the whole process of sampling.

7.Avoiding, hindering or refusing to check and order relevant information from competent authorities.

8.Soil Pollution Assessment Investigation Personnel and his/her Spouse, relatives by blood within the third degree of relationship or relatives by marriage within the second degree of relationship is the responsible person, director, or employee of the enterprise related with assessment and investigation.

9.Other cases that are not carried out in accordance with the regulations.


Training

A.Regulations

The trainings of Soil Pollution Assessment Investigation Personnel are handled in accordance with the “Training and Management Regulations for Environmental Protection Specialist and Technician”.

Registration and Re-registration

A. Registration

(A)Article 4, Paragraph 1 of RMSPAIP

People who meet the qualifications for the registration of Soil Pollution Assessment Investigation Personnel shall submit relevant documents and apply for registration to MOENV within 3 years from the day after obtaining the training certificate.

(B)Article 4, Paragraph 2 (front section) of RMSPAIP

Registration (re-registration included) is valid for 4 years.


B. Re-registration

(A)Article 4, Paragraph 2 (back section) of RMSPAIP

From 3 months before the expiration of the registration to 3 years after the expiration of the registration, Soil Pollution Assessment Investigation Personnel shall submit relevant documents and apply to MOENV for re-registration.

(B)Article 5, Paragraph 1 of RMSPAIP

Before applying for re-registration, Soil Pollution Assessment Investigation Personnel should attend soil or groundwater-related courses approved by MOENV for at least 32 hours.
